Assalaamu'alaykum warahmatullaahi wabarakaatuh,

I read on the riwayah of Abdullaah Umar ra. he divorced his wife while his wife had menses. Rasulullaah SAW told him to go back to her as it was not count as a talaq.
What if the wife said khula' i.e "From today I am not your wife anymore."
She asked one Imaam to be her witness but the Imaam didn't get back to her.

My question are:
What are the requirements to do khula'? Does those words count as khula' even there is no witness?
Does those words count as khula' eventhough she was on her menses?

Assalamu alaikum

Due to some pressing engagements, I will not be answering any Fiqh questions until December 2009, except for Ramadan & Haj fiqh questions during those months.

But as we wrote elsewhere on this forum, please do NOT ASK any Fiqh questions on www.SunnahINspirations.org/forums but rather ask Fiqh questions at www.IslamicLessons.com/forums  Sheikh Abu AbduSittir will be answering questions for the rest of this year on that forum until I return next year inshallah.

We moved the Q&A to that forum while other matters are left on this forum here.
